电影《永不妥协》讲述的是一个由环境问题引起的环境公益诉讼，这是美国历史上赔偿金额最大的环境公益诉讼。环境公益诉讼制度在美国环境立法体系中发挥着重要作用，也对世界各国环境公益诉讼的建设和创新产生了积极的影响。

本文以美国环境公益诉讼制度为基础，通过电影情节和理论内容的分析，致力于研究美国环境公益诉讼制度的特点及内容，并对我国环境公益诉讼制度的完善提出合理可行的建议。文章首先阐释了美国环境公益诉讼制度的产生和理论基础，其次结合电影情节分析美国环境公益诉讼制度的特点，然后从环境公益诉讼的分类、原告起诉资格、告知义务、救济措施、诉讼费用等方面分析美国环境公益诉讼制度的内容，最后对我国环境公益诉讼制度的完善提出建议，如扩大原告起诉资格、设置行政程序前置、培育环境侵权公益诉讼的社会组织、坚持依法调查取证、合理分担诉讼费用等。

我国作为社会主义国家，人民群众是国家的主人，政府的职责便在于维护好最广大人民群众的根本利益。因此，有关部门要着眼于人民群众的利益，从现实可行性和法律稳定性的角度出发，构建具有中国特色的环境公益诉讼制度。
