Abstract

With China's successful accession to the WTO, more and more translators have realized that the importance of the translation of business laws. Many translation theories have been put forward, however, they only focus on practical translation skills for individual words and sentences, and we can hardly find comprehensive and systematic study of business laws. Legal language has its own features such as precision, formalness, conciseness, and impassiveness. Due to its special features, some specific qualities are required for an eligible business laws translator. This thesis puts forward some translation techniques, such as conversion, amplification, transaction of terminology, voices, and phrases, syntax recast for business laws. At last, the thesis makes a comparison between two versions of the CLPRC to identify the characteristics of the application of these skills in business laws translation practice.

摘　要

中国成功加入世贸组织以后，越来越多的翻译者认识到翻译商法的重要性。学者提出了很多翻译理论，然而，这些理论仅仅关注个别词语或句子的翻译技巧，我们无法找到全面系统的课题。法律语言有着自己独特的特征，例如精确、正式、简明和冷漠。正由于这些特征，合格的商法翻译者需要具备特定的品质。该论文提出了一些商法的翻译方法，分别是：变换，扩大，法律术语、语态和短语的转换，以及句法重铸。最后，本文比较了《中华人民共公司法》的两个版本，指出了这些翻译方法在商法翻译中的实际运用特征。

1. Introduction of Business Laws
With the rapid development of global economy and the increasing frequency of international exchanges between countries, persons and organizations, various laws have been playing an increasingly important role and no one will deny the penetrating functions of laws on people's daily lives in modern society. In China, during the process of constructing a society ruled by laws, we almost use the expressions of "laws" and "ruled by laws" every day.
Law is a system of rules and guidelines, usually enforced through a set of institutions. It shapes politics, economics and society in numerous ways and serves as a social mediator of relations between people.
1.1 Definition of business laws
Business laws, which are also called commercial laws, are the body of laws that govern business and commercial transactions.
Business laws usually include contract law, sales law, company law, negotiable instrument law, marine law, insurance law, etc.
