摘 要
本文主要介绍了语言学家尤金•奈达的功能相对翻译理论在涉外合同中的应用。功能相对理论的核心是要原文与译文做到“最贴近、最自然”的对等。尤金•奈达的翻译理论不仅对世界作出了贡献,而且给我国翻译界也带来了新的活力。我国在全世界的经济地位,决定了涉外合同在国际贸易活动中的重要性。涉外合同作为一种法律文件,本身具有专业性与特殊性,其语言相当正式、简洁且严肃,对其的翻译要求也是非常严格的。此文中运用了很多例子,对涉外合同翻译的规范性、准确性、严谨性与翻译的方法及技巧进行了分析及归纳。在英汉商务合同的翻译中若能根据商务合同自身特点,遵循翻译理论与原则,同时充分利用功能对等理论进行指导,消除对外贸易中的语言壁垒不再是梦想。

Abstract
The article mainly discusses Eugene Nida’s “Functional Equivalence” theory with some basic knowledge about foreign contracts and translation techniques, and how to translate the foreign contracts more effectively by using consistency, authenticity and fluency principles. The core of this theory is to make the source text and the target text achieve the most closed and natural equivalence. Eugene A. Nida's translation theory not only made contributions to the world, but also brought new vitality to the Chinese translation field. It is the position of our country in the world economy that determines the importance of foreign contracts in international trade activities. In international business trade market, foreign contract has become a vital element. As a legal document, foreign contract itself has the specialty and particularity whose language is simple, formal and serious. So the requirements for translating the foreign contracts are really strict. This paper uses a number of examples to summarize and analyze the preciseness, accuracy, normalization and translation methods while translating the foreign contract. According to the characteristics of business contract itself, if the translator can make full use of the functional equivalence theory as the guide, and follow the translation theories and principles in the translation of business contracts between English and Chinese, it’s possible to eliminate the language barriers in foreign trade. Finally some advice is given to draw readers’ attention to the problems in translation.
