摘  要

本文首先为英格兰法官的贵族精神下了一个定义, 然后分别从历史和社会背景两个角度探究了这种贵族精神的来源。并且归纳了贵族式法官对英格兰人的法律生活、政治生活等方方面面所造成的影响。此外还分析了贵族精神背后所特有的文化特质和精神内核。最后，文章讨论了这种英格兰的贵族式法官对中国的借鉴意义。并提出了在当前情况下面对中国的司法改革，我们应更注重对法官的精英教育，从而为进一步发展法治社会奠定基础。
法官是现代社会中一个非常特殊的群体。他们与立法者和行政官员不仅仅在所从事的事业上有所不同，甚至在思维方式和行为习惯上都有其极其特殊的地方。法官的专业化与职业化是现代法治社会的基础，而贵族精神又是法官专业化与职业化的基础。因此，在考虑我国司法改革的时候，如果能把对法官的精神熏陶把摆在一个相当重要的位置的话，将会大大提升效率。

ABSTRACT

The present paper aims to analyze the noble spirit of English judges, so as to find out the most effective way for China’s judicial reform.
The paper first defines the noble spirit of English judges，and then analyzes the historical and the social origination of noble spirit. Furthermore it concludes the noble spirit’s functions and influence upon the legal and political life of English people. Finally, this noble spirit will be taken as a reference for China and the paper points out the essential approach to improve judges’ quality is by enhancing our legal education.
Judges are a very particular group in present-day society, who are totally different from administrators or lawmakers. This difference does not only lie in the business they charge for, but more importantly it is reflected in their behavior, their position and their way of thinking. The profession and specialization of judge class is the foundation of a legal society. Yet, the noble spirit is the foundation of judge profession and specialization. Therefore, in our China’s judicial reform, we’d better put the spiritual cultivation onto top priority. Only in this way, can we achieve success in a more efficient manner.

1    Introduction
1.1 The Motivation of the Study
China has been conducting our judicial reform for many years. During the process, we find that the quality of judge is a big obstacle confronting us. We all know that, compared with Roman Law, Common Law attaches greater importance to the quality of judges. And as the originating country of Common law, English judges carry a very special culture texture. This culture texture not only makes English judges as the incarnation of justice, but also enlightens the torch of modern legal society. Therefore, an analysis on the English judges’ noble spirit can pave a more efficient way for our judicial reform.
