On the Influence of Legal Cultural Differences on the Translation of Legal Terms in International Business Law

摘要

在众多影响国际商法法律术语翻译质量的因素中，法律文化差异的影响尤为巨大，英美法律文化的差异使译者在翻译的过程中面临着很多难题，无法翻译得比较准确，从而在很大程度上影响法律文本的翻译质量。准确严谨是法律术语翻译的基本准则，这就要求译者在翻译时不仅要使译文符合目的语的特点也要保留源语文本内涵。本文首先介绍了国际商法中的法律术语及其翻译，并指出翻译中存在的问题;接着介绍了法律文化的定义、特征和国内外法律文化的差异，同时探讨了引起法律文化差异的原因和对法律术语翻译的影响。最后，为了解决翻译中出现的问题，作者探讨了遵守的翻译原则，并提出要适当运用的一些翻译策略，比如使用直译、意译、音译和创译。只有这样我们才能减少误译，使自己的翻译技能达到更高的水平。

Abstract

Among the factors that can influence the translation of legal terms in international business law, the differences of legal cultures play quite an important role and make it quite difficult for translators to translate legal terms accurately, which will definitely affect the quality of the translated texts. Being accurate and rigorous are the most important characteristics of legal term translation in international business law, which demands that translation should not only make the translated text conform to the features of target language, but also reserve the implications of the source text in the translation. In the thesis an introduction is first made of the legal terms and problems in legal term translation in international business law. Then, an introduction of legal culture is made, including the definition of legal culture, characteristics of legal culture, legal cultural differences between China and western countries, causes for the legal cultural differences and the influences of them. Finally, in order to overcome all the obstacles, some principles of legal term translation are discussed together with a proposal of some translation strategies, like free translation, literal translation, transliteration and creative translation. Only in this way can we reduce mistranslation and enhance our translation skills to a higher level.
