On the Features and Translation of Legal Terms in the Sale of Goods Act 1979

摘要

随着全球化进一步深入，中国进一步推进改革开放，法律翻译在国际交往中扮演着越来越重要的角色。法律术语翻译是法律翻译中的一个非常重要的方面。从某种程度上说，法律术语翻译的好坏直接关系到整篇法律文件翻译质量的高低。本文主要采用案列分析的方法，以英国《货物买卖法1979》为例，首先从词源、词义与风格的角度分析该法中法律术语的特征，然后探讨这一文本中的翻译原则，最后分析翻译这一文本所用到的翻译方法，如直译、意译等等。希望能够通过本课题的研究，为具体法律文本中法律术语翻译水平的提高尽一份力，从而达到提高法律文本翻译质量的目的。

Abstract

With the deepening of globalization, China has further promoted the process of reform and opening-up, and legal English translation is playing a more and more important role in the international communication. Translation of legal terms is a very important aspect of legal translation, and to some extent, the quality of legal term translation directly influences that of the entire legal document translation. In this paper, the features and translation of legal terms will be discussed based on a case study of the Sale of Goods Act 1979. Firstly, the features of legal terms in the Sale of Goods Act 1979 will be analyzed from the perspectives of etymology, meaning and style. Secondly, the principle of legal term translation will be discussed. Finally,  the detailed translation methods will be explored, such as literal translation, free translation and so on. It is hoped that the study of this paper will be beneficial to the improvement of the translation of legal terms in specific legal texts, which will be helpful to the enhancement of the translation quality of legal texts.
