从功能对等看英语商务合同的翻译_英语论文

On the Translation of English Business Contracts from the Perspective of Functional Equivalence

摘要

随着经济全球化的发展以及中国对外贸易越来越频繁，英语商务合同作为一种具有法律效力的文件，在建立双方贸易平等方面占有重要的地位。为了准确地再现源语文化和消除文化差异，奈达从语言学的角度出发，根据翻译的本质，提出了著名的“动态对等”的翻译概念，即功能对等理论。“动态对等”中的对等包括四个方面:词汇对等，句法对等，篇章对等和文体对等。在这四个方面中，奈达认为“意义是最重要的，形式其次”。本文以功能对等角度出发，列举了商务英语合同中大量的例子来分析在功能对等指导下商务英语合同的翻译。从功能对等角度对英语商务合同的翻译方法进行分析、总结，有助于人们更加关注商务英语合同的正确规范的翻译方式，对其使用意图以及其增加语言说服力、增强自我保护、激发兴趣等功能有进一步的了解。

Abstract

With the development of economic globalization and more and more frequent foreign trade of China, English business contract, as a legally binding document, are very important in establishing the equality of bilateral trade. In order to accurately reproduce the source culture and eliminate the cultural difference, Nida, from the perspective of linguistics, based on the nature of translation, puts forward the famous “dynamic equivalence” in translation, namely Functional Equivalence Theory. The functional equivalence in this theory includes four aspects: words equivalence, syntactic equivalence, textual equivalence and stylistic equivalence. In these four aspects, Nida thinks that meaning is the most important, then is the form. The paper gives a large number of examples of English business contracts to analyze the translation of English business contracts under the guidance of Functional Equivalence. Using Functional Equivalence to analyze the translation methods of English business contract can help people pay more attention to the proper translation methods of business English contracts, thus, it can make us know more about the intention of business contracts as well as their functions, including strengthening the power of persuasion in language, enhancing self-protection, stimulating further interest and so on and enhance the power of persuasion in language.
