Compensation in E-C Translation of International Business Contracts

摘要

在过去几十年间中国大大扩展了与其他国家的经贸交易活动。对于从事经贸交易活动的人来说，签订国际商务合同成为了必不可少的步骤，合同的签订是为了规范合作双方的行为确保合同顺利进行，保证合作双方不会出现违约行为以及保护双方的合法利益。在国际上签订的合同时，双方交流大多是通过合同翻译来进行的。若处理不当，仅以一种语言来制定合同，必然会损害另一方的利益。所以对于合同翻译的需求，尤其是高质量合同翻译的需求也越来越迫切。

本文共分为三大部分，第一部分笔者首先介绍了国际商务合同的基本概念、组成结构、主要特点及其在汉译过程中的难点与原则。第二部分简要介绍了补偿研究的定义。最后在此基础上，结合具体的国际商务合同案例，分析国际商务合同汉译过程中出现的零补偿、正补偿和负补偿。

Abstract

In the past few decades, China has greatly expanded economic and trade transactions with other foreign countries. For those people who engaged in economic and trade transactions, international business contracts have become indispensable. The aim is to regulate the behavior two sides, ensure no breach of the cooperation and to protect the interests of both sides. When an international contract signed, bilateral communication is mostly based on contract translation. If mishandled, it will damage the interests of the other party. As a result, the demand of contract translation, especially the high quality contract translation is becoming more and more urgent.

This paper is divided into three parts. The first part introduces the basic concept of international business contracts, structure, stylistic features, difficulties and principles in the process of Chinese translation. The second part briefly introduces the definition of compensation research. Finally on this basis, translation compensation is discussed including zero compensation, positive compensation and negative compensation.
