摘要

中国近代法律翻译肇始于清末，在建国后不断发展，改革开放后走向繁盛。而无论在中国，还是世界上其他国家，法律移植都是与法律翻译联系在一起的。当一个国家希望学习、借鉴、吸收其他国家的法律时，由于是不同的语言，就必须将他国的法律及法学著作先翻译为本国的语言，然后才有可能作出判断、作出评价、作出采纳与否的选择。从中国近现代法律发展史看，自清末修律至之后的一百多年，中国不断向国外先进法律国家学习，大量地参考和借鉴西方国家的法律和制度、国际通行惯例和国际公约。本文从法律移植的各历史阶段出发，分析了各阶段法律翻译在法律移植中的作用。研究发现，法律翻译伴随着中国法律移植的始终，不仅促进了中国语言文字的发展和译学研究的发展，更极大地推动了中国法制近代化和现代化进程。
