Abstract

With the development of economic globalization and China’s socialist market economy, the exchange of China and foreign countries has become increasingly frequent, which greatly needs the translation of foreign legal documents into Chinese. Legal translation becomes an important medium of legal communication among different countries. Accuracy is the most prominent features of legal translation which demands the translation to conform to the features of the target legal language as well as to keep the connotation of source language. Legal term is the most important part of legal language and its translation directly influences the quality of legal translation. Peter Newmark proposes the strategies of semantic translation and communicative translation, which provides new angle of view for translating legal terms.
The thesis first gives an overview of the previous studies of legal terms, and then introduces the definition and features of terms from the perspective of Ontology. What’s more, it discusses the features and translation principles of legal terms. Finally, the thesis discusses the translation of legal terms according to semantic translation and communicative translation proposed by Newmark.

摘要

随着经济一体化和社会主义市场经济的发展，我国与其他国家间的交流日益频繁，难免需要将国外的法律文献翻译成中文，因此法律翻译成为不同国家间法律交流的重要媒介。严谨准确是法律翻译最大的特点，这要求译者的翻译既要符合目标语法律语言特点又要保留源语文本内涵。法律术语是法律语言最重要的组成部分，其翻译是否得当直接影响法律翻译质量。纽马克提出了语义翻译和交际翻译的方法，为译者更好地翻译法律术语提供了新的视角。
本篇论文首先对前人关于法律术语的国内外研究进行综述，然后从本体论的角度介绍术语的定义和特点，在此基础上探讨法律术语的特点及翻译原则。最后根据纽马克提出的语义翻译和交际翻译方法，探讨法律术语的翻译。

1.1 The Purpose and Significance of the Study
In recent years, the economic globalization is strengthening continuously. China’s economic and cultural communication with other countries has expanded enormously and unceasingly while the domestic market economy system is developing increasingly. Entering WTO makes China integrate into the international economic environment. However, China’s modern market economy system deadly needs modern legal system to escort its sound development. The transplanting of western law is inevitably one of the important ways to modernize Chinese legal system, which requires a large range of translation of western laws and regulations. In legal translation, the accurate translation of legal terms is particularly important, which is greatly related to the translation quality of legal documents.
